{"id":658,"date":"2015-11-21T16:44:24","date_gmt":"2015-11-21T16:44:24","guid":{"rendered":"https:\/\/www.cybershooters.org\/?p=658"},"modified":"2015-11-25T23:02:05","modified_gmt":"2015-11-25T23:02:05","slug":"brussels-panics","status":"publish","type":"post","link":"https:\/\/www.cybershooters.org\/?p=658","title":{"rendered":"Brussels panics"},"content":{"rendered":"<p><span style=\"color: #000000;\"><span style=\"text-decoration: underline;\">21 November, 2015<\/span> &#8211; The appalling terrorist attacks in Paris on Friday 13th appear to have led to a degree of panic at the European Commission.\u00a0 It was widely expected that the Commission would announce this month <\/span><a href=\"http:\/\/ec.europa.eu\/DocsRoom\/documents\/13965\/attachments\/1\/translations\/en\/renditions\/native\">changes to the European Firearms Directive<\/a><span style=\"color: #000000;\">, but they are far more sweeping than anticipated and appear to have been influenced by recent events.\u00a0 Unfortunately, European legal jargon makes the <\/span><a href=\"http:\/\/europa.eu\/rapid\/press-release_IP-15-6110_en.htm\">press release<\/a><span style=\"color: #000000;\">\u00a0difficult for the layman to decipher, in addition certain things were so last-minute that they don&#8217;t even appear in the press release,\u00a0but here is what is actually being proposed:<\/span><\/p>\n<ol>\n<li><span style=\"color: #000000;\"><strong>Prohibition of semi-automatic firearms that &#8220;resemble&#8221; automatic firearms<\/strong>, by moving them from Category B to Category A of the Directive.\u00a0 No-one has ever been clear on what they were referring to and until now it didn&#8217;t matter as nearly all semi-automatic firearms were in Category B.\u00a0 However, moving them to Category A would cause mass confusion across the EU and no doubt different countries would interpret such a ban in different ways.\u00a0 In the UK, it would mean that legal guns like the <\/span><a href=\"https:\/\/www.cybershooters.org\/?page_id=602\">S&amp;W M&amp;P 15-22<\/a><span style=\"color: #000000;\"> would probably be prohibited.<\/span><\/li>\n<li><span style=\"color: #000000;\"><strong>Prohibition of deactivated Category A (prohibited)\u00a0firearms<\/strong> &#8211; your deactivated Sten gun would be banned!\u00a0 There are probably somewhere around 200,000 such deactivated firearms\u00a0in the UK.\u00a0 Only museums would be allowed to own them and even they would be banned from acquiring more.<\/span><\/li>\n<li><span style=\"color: #000000;\"><strong>Prohibition of private collections of Category A firearms and ammunition<\/strong>, including by museums!\u00a0 The press release talks of &#8220;tighter&#8221; controls, so it was obviously drafted before they changed their minds.\u00a0 As written, this would basically mean the <\/span><a href=\"https:\/\/www.cybershooters.org\/?p=311\">Royal Armouries<\/a><span style=\"color: #000000;\"> and so on would have to deactivate their vast collections.\u00a0 The draft does talk of firearms held by: &#8220;public authorities&#8221; being exempt, however this was clearly intended to mean police organisations, not museums, which are often partially or wholly owned by private entities.\u00a0 In some EU countries, it is still legal to collect prohibited firearms and even in the UK it is technically legal to collect limited types of prohibited firearms &#8211; but in reality the main impact in the UK would be on collectors of prohibited ammunition, who would see their collections banned.<\/span><\/li>\n<li><span style=\"color: #000000;\"><span style=\"color: #000000;\"><strong>Registration of deactivated Category B and C firearms as well as blank-firing imitations and replicas<\/strong>\u00a0&#8211; yes, it says these must be: &#8220;declared&#8221; to the authorities, in other words, registered with the police.\u00a0 So basically with the exception of deactivated single and double-barrel shotguns, any deactivated firearms you own which aren&#8217;t banned would have to be registered with the police.\u00a0 How the registration requirement for blank firers and replicas would work is hard to know as many of them lack serial numbers.\u00a0 Also not clear what: &#8220;replica&#8221; covers.\u00a0 The\u00a0draft says:\u00a0&#8220;<\/span>objects that have the physical appearance of a firearm&#8221; &#8211; doesn&#8217;t that include airsoft guns and even some toys?<\/span><\/li>\n<li><span style=\"color: #000000;\"><strong>Prohibition of private sales of firearms over the internet<\/strong>, with the exception of Category D firearms.\u00a0 So say you decide to put your rifle up for sale on the forum on this website, you would be breaking the law!\u00a0 Only licenced dealers would be exempt.\u00a0 Bear in mind they want blank-firing imitations in Category C as well, so trying to privately sell one of those over the internet would also be illegal.<\/span><\/li>\n<li><span style=\"color: #000000;\"><strong>A requirement for: &#8220;standard medical tests&#8221; before any authorisation to acquire a firearm is given.<\/strong>\u00a0 The BMA and Royal College of Psychiatrists have in the past said no such suitability\u00a0test is possible and in any event, even if\u00a0it were, the resources don&#8217;t exist.\u00a0 <\/span><a href=\"https:\/\/www.cybershooters.org\/?p=646\">HMIC recently pointed out<\/a><span style=\"color: #000000;\"> the problems with this approach and\u00a0they were\u00a0merely\u00a0talking about the\u00a0current\u00a0check with your GP.<\/span><\/li>\n<li><span style=\"color: #000000;\"><strong>A common EU-wide\u00a0deactivation standard for firearms and a common specification for blank-firing imitations.<\/strong>\u00a0 Unlike the stuff detailed above, this has been in the works for years.\u00a0 <\/span><a href=\"http:\/\/ec.europa.eu\/DocsRoom\/documents\/13965\/attachments\/4\/translations\/en\/renditions\/native\">The proposed specifications<\/a><span style=\"color: #000000;\"> are largely based on the current UK specifications, the principle difference is that deactivated firearms would have to have the magazines welded\u00a0in (and pistols would have the slide stop welded in place).\u00a0 This is to make sure the standard works in EU countries where the magazines are subject to control, such as France, where magazines with a capacity of more than 10 rounds are licenced.\u00a0 These new specifications will be introduced by regulation under the EFD as it currently stands and will come into force in three months (although it will take longer than that for member states to transpose them into national legislation).<\/span><\/li>\n<li><span style=\"color: #000000;\"><strong>Better information sharing between member states and common marking requirements for firearms.<\/strong>\u00a0 These have also been in the works for many years.<\/span><\/li>\n<li><span style=\"color: #000000;\"><strong>A requirement that licenced dealers and brokers keep their records indefinitely<\/strong> &#8211; this was\u00a0extended to 20 years in 2008.\u00a0 It&#8217;s a bit pointless in countries like the UK where the police are supposed to have all firearms subject to the Directive registered and it does raise the practical question of how to keep records indefinitely in long-term, often\u00a0family-run businesses.\u00a0 Theoretically dealers could destroy their records when the firearm is destroyed, in practice though it&#8217;s hard to see how that would be workable.\u00a0 How would a dealer be notified when a blank firer is destroyed?<\/span><\/li>\n<li><span style=\"color: #000000;\"><strong>A requirement that authorisations to possess firearms cannot be for longer than 5 years.\u00a0 <\/strong>This would make no practical difference in the UK at present, although extending the validity of certificates for longer than that wouldn&#8217;t be possible.<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">Obviously this is a Draconian set of proposals and it\u00a0is paramount that you <\/span><a href=\"http:\/\/www.europarl.europa.eu\/meps\/en\/map.html\">contact your MEPs<\/a><span style=\"color: #000000;\"> as soon as you can, to protest.\u00a0 Preferably make an appointment and go and see them.<\/span><\/p>\n<p><span style=\"color: #000000;\">The reaction of the Commission is reminiscent of the Firearms Act 1920 being enacted after the <\/span><a href=\"https:\/\/en.wikipedia.org\/wiki\/Battle_of_George_Square\">Glasgow riots<\/a><span style=\"color: #000000;\"> in 1919 or the US Congress enacting the National Firearms Act after <\/span><a href=\"https:\/\/en.wikipedia.org\/wiki\/Bonus_Army\">the Bonus Army<\/a><span style=\"color: #000000;\"> showed up in 1932.\u00a0 For the first time ever, I&#8217;m glad the European Parliament spends a lot of its time in Strasbourg.<\/span><\/p>\n<h3><span style=\"color: #000000;\">The\u00a0UK referendum on EU membership<\/span><\/h3>\n<p><span style=\"color: #000000;\">It&#8217;s easy to get distracted by this referendum, the proposed changes to the Directive have obviously led some shooters to think the UK would be better off outside the EU.\u00a0 At this point it&#8217;s not clear what would happen if the UK left the EU, it could remain in the EEA and thus the Directive could still apply to the UK.\u00a0 It&#8217;s a threat either way and needs to be stopped.\u00a0 Also, one wonders whether it would be drafted in such a Draconian manner if Switzerland were in the EU!<\/span><\/p>\n<hr \/>\n<p style=\"text-align: center;\"><em><span style=\"color: #000000;\">&#8220;Times of crisis are the true test of a democracy.&#8221;
