This is a very controversial case.
Outrage over acquittal.
So on the one hand, the story is they had a flat tyre and drove up to ask for help, on the other hand, they were burglars, he got a gun and it "went off" accidentally.
There is evidence they were there as burglars (or at least a reasonable person would think they were), it's hard to believe they could have driven that far on a flat tyre for starters and there's testimony that they were trying to steal an ATV, also they had a rifle in the passenger compartment of the car.
However the farmer went and got the gun, loaded the gun, fired warning shots, then pointed the gun at the man who was shot without knowing there was a rifle in the car and the forensic evidence is that the Tokarev was working properly.
Even if they were burglars, there's no evidence the farmer's life was in immediate danger and he doesn't claim self-defence. The jury seems to have believed his explanation that it was an accident. Which is a bit of a stretch, imo. Even if it was an accident he clearly must have pulled the trigger, which makes him liable. _________________ Steve.
