Article.
This is a truly bizarre court case, because the NFA argued the exact opposite when the Federal registry was established. Essentially they argued that property rights were purely a provincial jurisdiction so a Federal property register was illegal, the Supreme Court disagreed and ruled that it also a criminal law and in the interests of public safety to establish a registry.
Now the NFA is arguing that a registry is criminal law, not property law, so a provincial registry is illegal. Huh? It's plain from section 92(13) of the Constitution that Québec has the power to do this:
Quote: | In each Province the Legislature may exclusively make Laws in relation to Matters coming within the Classes of Subjects next hereinafter enumerated; that is to say,
... 13. Property and Civil Rights in the Province. |
And that is exactly what they argued themselves previously!
Let's be clear that it is a completely stupid law because the licencing is Federal, so anyone in Québec can easily evade the registration law by acquiring a firearm outside of Québec, but Québec has never been known for its sensible laws. _________________ Steve.
